A Positive Approach to Divorce and Family Law
Divorce is not an easy process and can bring up many problems. Often, the issues that were contentious in a marriage are brought to greater light during this time. I encourage my clients to take a positive approach and to make proactive decisions about their futures and their children's futures.
I often recommend counseling to ensure that both parties have explored all options prior to filing for a divorce. If we can salvage a relationship through reconciliation and counseling, we will work toward that goal. As a family law attorney, I am committed to reaching reasonable and practical resolutions on behalf of my clients.
Important Issues in a Divorce
Division of property: I reasonably, but aggressively, pursue a fair and equitable division of assets using a creative negotiating strategy within the confines of California law. I look at every asset, from pensions and retirement plans, to personal property and real estate.
Child custody and parenting plans: I represent clients at the court mandated mediation to help you work out an arrangement that best serves your child.
Child support: The amount that a spouse will be obligated to pay is usually calculated based on the parent's incomes and how much time each of them spends with the children. I will help you arrive at these numbers, as well as advise the court of special circumstances that may change this amount.
Spousal support: Spousal support (alimony) is not awarded in every situation and is dependent upon many factors. The courts will consider matters such as the length of the marriage, the lifestyle established during the marriage, property division, and other factors. Temporary spousal support may be awarded.
