Since 1976, I have been helping people find reasonable, practical solutions to family law concerns using traditional negotiation and litigation, limited scope representation, and alternative dispute resolution (ADR) methods such as mediation.
Understanding Mediation
Mediation is a voluntary form of alternative dispute resolution. It allows the parties involved in a dispute to choose a neutral third party to help them in work out their own solution to the issue at hand. The parties meet with the mediator and work together toward reaching an agreement.
Because mediation is non-binding, it has very little downside risk. If negotiations fail, the case can simply proceed toward trial. All information discussed during mediation sessions is confidential and is not allowed to be used against you in any future litigation.
With family law the focus of my law firm, I have found mediation to be a very positive way for people to resolve disagreements and to develop solutions to problems such as:
- Divorce: Mediation can be a very positive way to work out a settlement that can be incorporated into your divorce decree.
- Property division: Mediation allows you to divide your property in a way both divorcing spouses can live with, rather than submitting it to a judicial formula. Mediation is also confidential and not a matter of public record, which appeals to many clients.
- Child support and alimony: With the assistance of a knowledgeable attorney, divorcing or unmarried couples can negotiate support agreements and submit them for court approval.
- Child custody and visitation disputes: Co-parenting requires both parents to be able to work together. Mediation of disagreements over parenting time can help maintain or even build the working relationship you need for the wellbeing of your children.
As your lawyer, I represent your interests during the mediation process and make sure that you don't make mistakes in the agreement that could be rejected by the court. During my more than 30 years of practice, I have found that the majority of mediation cases end in a satisfactory settlement, saving my clients valuable time, money and emotional energy.
